Preference is given to those who have taken the course on Proactive law and the Prevention and Resolution of Disputes

Learning outcomes

The aim of the course is to give the students an overview of a proactive approach to contracting and its role in different aspects of management, resource planning, risk and opportunity management, strategic communication and avoiding disagreements. Students will acquire an understanding of contracting as a management tool.

Contents

A short introduction to proactive and preventive approaches to law is given and shown how they can be applied to contracting and risk management all through the contract life-cycle. Contractual risk management versus opportunity management and areas of contractual risks and their management tools are explained. The focus is on enabling methods, tools and good practices.
The topics will cover:
-the different phases of contracting and contracts as part of the value creation for the enterprise
-management of quality risk, measures of quality KPIs, use of standards and some of the most commonly used self-regulation schemes in different industries
-the role of private regulation: self-regulation, code of conducts, standards, certifications, general terms and conditions.

Lectures 20 hrs, assignments including, team-work and presentation (5 credits), students who wish to earn the additional 3 ECTS will write a 15-20 page paper on one of the topics discussed in class and present it orally in a seminar.

Evaluation and evaluation criteria

Numeric 0-5.
Active participation, completed written and other assignments and a written lecture review/journal (5 credits), the students wishing to earn 3 credits more will receive separate grades based on the written papers and oral presentations at the seminar.
