General description

We will cover basics about the legal system in the United States and the labor relations system in the United States. We will read seminal cases in the labor relations area and essays that tell the stories behind these cases. We will consider any pending or new legislation in the labor relations area and discuss the significance (or lack thereof) of international law in the labor relations area.

Learning outcomes

Understand the structure of the United States legal system and the various types of legal materials used in the United States
Read and understand seminal labor relations cases in the United States
Set a seminal labor relations case into its legal, social, economic, or historical background
Understand the process involved in advising a client on a labor law issue

Evaluation and evaluation criteria

Numeric 0-5.
20% of the grade is the role-play presentation which will assess ability to assess a proposed change to the law. 80% of the grade is the written take-home exam which will have two questions. One will ask students to advise a client on a Labor Law problem. The other will ask the students to read the story of a seminal case and to write about what they learned about the case that wasn't apparent from simply reading the case.

Labor Law Stories (Laura J. Cooper & Catherine L. Fisk, eds, Found Press 2005) and materials posted on TWEN a service provided by Westlaw for which you will be able to sign up in order to access the materials via the Internet

TIME: IV period
SELECTION CRITERIA: Participation is limited to 24 students. 1/3 of the places is reserved for the degree students of the Faculty of Law. For the remaining places, the following criteria will be used to select the participants:
1. exchange students of the TLS cooperative institutions
2. degree students of the TLS cooperative institutions
3. other law students
4. non-law students
