Learning outcomes

The course aims at giving an understanding of the problems of regulating in the European setting, where national jurisdictions interact with the European Union and the international human rights instruments. The emphasis is on the increasing use of soft law instruments on all these levels, while simultaneously rule of law, judiciable rights and protection of democratic institutions are high on the agenda.


The course gives theoretical insight into the relation of polities (nation state, European Union, international organisations) and their regulative options. While using legislation as a regulative tool has been the hallmark of modern states as well as the EU, a turn to using soft law measures, including co-and self-regulation has taken place. There is a recognised interest to global level regulation, but the political global level organisations do not have the same regulative options that the nation state has. The ideological, economic and other motivations for using specific forms of regulation, as well as concrete examples of regulation are discussed.
